Dear Sir, First i would like to introduce myself that i am an advocate practicising in Chennai in the specilized field of Customs and Central Excise, Service Tax., I need your advice in the property matter. The case is My father in law (fil in short) has got 4 sons and two daughters. All of them and my mother in law is also alive. Out of my father in law's own earning he purchased a property in Madipakkam measuirng 3600 sq.ft. but registered in the name of his elder son in the year 1981 when he was 11 years old. Mother and natural guardian was my mother in law. My fil though illetereate he can put is siganture and he was employed at dubai for sometime. During the minority of his elder son, he did not transfer the property. In the year 2005, all the family members sat and came for the settlement of property. Accordingly to the wish of my fil the property was to given all his 4 sons equally. Two daughters were married and settled. At the time of this oral partition the daughter took some money from all the 4 sons and gave an undertaking syaing that they recd this moneythat they dont have nay objection against hteir brothers in getting their share of property. 3600 sq.t. was divided into 4 parts and each one's share became 900 sq.ft. All the time executing documents of their respective shares, the second son of my fil by way of sale deed got his share from elder brother. On the same itself, the elder son settled the share of his other sons by way of settlement to Fatherinlaw, since the settlement is within family and no need spend much amount as stampduty. Subseuquently in Mar 2006, the third son by way of settlement obtained his share of proeprty from his father (fil), later on Mar 2007 the last son also got share of his property by a settlement deed from is father. Accordingly they all acted upon. BOth the settlements are absolute and carries an expression it is irrevocable and no condition attahced to that. Suddently due to some family problem, and due to the reason the property value has gone high, the daughters poisoned the mind of my fil and instigated him to issue notice staing that those doucments were obtained with my fil knowledge. Accordingly my fil sent legal notice to us on 10.09.2008. stating that it was made iwhtout his knowledge and he is likely to cancel the documents executed by him. The 4 sons also send notice stating that all the docs were executed with his knowledge. On 03.11.2008, after quarelling my the third son, he who was residing in that premises, sent them out of the house, and subsequelty he cancelled the settlement deeds executed by him in favour of two sons by way of registereing a cancellation deed which has been witnessed by his two daughters and son in laws. This is was not brought to the notice of his sons so far in written or through oral by him. Now in the month of Aprol 2009 he called his younger and asked him to vacate the house saying he cancelled the settleemtn deed ( Not by court order). Out of 4 sons all the three elder sons are in abroad, and the last son is only there.. Inspite of all this we have providing for his foods and taking care of all the need of him. Now wat is request you to clarify is that. 1, Is that cancellation deed is valid. or wat is the effect of such cancellation deed (Original settlement deed executed in favour of his sons were with respective sons only and the they have mutuated tame transfer in all the revenue records also like tneb, proepty tax etc.,) 2. e i need a whole book to write the entire story i am going to write this in short. i need your opinion on this..note- since its a really long story, im using a time line. im using his name as X 1958- x is born to a a family who struggles to meet ends meet. x has an elder sister and soon 3 younger brothers. x father takes loans from all the banks available to educate x and his brothers. 1975-at the young age of 17, x joins merchant nave as a cadet and send whatever he earns to his parents. 1984-at the age of 30, xs sisters mariage is conducted by x. in the mean time, x repays all the loan his father has taken for the education of his brothers. 1986- x is a chief officer in the merchant navy, starts the building of his new home 1987- earns a salary of us$2000 pm , marries, and comletes teh construction of his house with the some of RS.3,00,000( $ 30,000 then) which he obtained as a dowry from his wifes family. keeps on giving his money to his parents brotehrs etc.works for 13 to 14 months continuously and comes back for 1 month and leaves again sending all the money he earns to his dad. money used to educate his brothers.in the meantime, he conducts the marriages of all his brothers.1 brother turns out to be a naval architect the other a doctor and the third an electrical engineer. 1990- he gave rs 50,000( $ 5000) each to his wife, uncle , brother and brotehr in law. 1991- 1st son is born.... when son is 6 months old, when his wife questions him about the need to invest for the child, his mother in law gets angry and a big fight takes place when she is beaten mericlessly which resulted in the loss of hearing in one of her ears.they tried to snatch son, but she dint give in... leaves her in her fathers house(who wanted to get back at him, but dint, because he had 2 marry off 3 daughters)...he abandons her and the chid in her fathers house for 11 months leaving no money for expense. girls father bears all the expenses. The same time- his brother who is a doctor(dentist), leaves for dubai with his wife...they have no money and x provides them everything(money for airfare, expense, rent etc) 1992- x comes back to his wife...forgives him..go to live togther again.in a seperate flat he bought for a sum of indian rupees 9,00,000.(his bank balance his 0 and he takes a loan for this) he continues to work and soon becomes a captain with a salary of $ (3000 plus)...his bothers are all in dubai.... 1995- x has a daugther.does not attend daugther baptism because his parenst dint let him go since the girl was not named after her mother. 1997- the brotehr who went to dubai in 1992, buys a new mercedes e 500 and a prado. lives in one of the most expensive location in dubai a 3 bed room flat..high tech systems etc. 1999- x resigns comes back. works as a pilot in the port. (bank balance 0 ...but in the meantime, he invested in an other property woth rs, 9,00,000 and cleared off his debts for the flat) bank balance 0 again till 2003, he stayed in the port with a monthly salary of rs 25000. bought a car for rs 4,50,000 on loan 2003- leaves for the gulf.. earns $ 3500 average for 4 years. buys an otehr house in india investing rs 28,00,000($62,2000).cleared the remaing car loan.($6.600) he then took an other loan for rs 20,00,000($ 45,000) he earned a total of $ 159,500 ( 4 years salary plus end of service benefits) which is about RS.72,00,000..the total family expenses of him and his wife and children durig this period are rs 17,2800 ($ 38400) plus an other loan he took rs 768000($ 17,066).....pus the investements he made which come to a total of rs- 40,000,00 ($89,975).. the remaing amount of rs 30,00,000($ 68,000) were missing and when his wife asked him about it he screamed and said it was her " EXPENSEes"!!! 2007 may- x joined a company in dubai...still there..earning about $ 5,000 per month..family still in india.....sends about @ 1,000 per month for expense of family and loans.2008.son wanted to change schools and when asked for money says he has nothing and is in debts!!!! wife borrows money from her brother and pays......family moves to dubai..earns month salary of $ 10,000 now..still in debt..... whenver x used to come for leave, he used to say with his wife and kids for a week and spends the remainder of his vacation with his parents...a person who has been earning $ 2,000 from 1987.-1995....@ $3000 -4000 till 2007...$ 5,000 from 2007 in debts???? at the same time his sister who earns rs 7000($ 140) a month , husband also a teacher $ 140 a month (retired)conducted her daugthers marriage with a dowry of rs.15,00,000($ 35,000) other expenses rs 10,000,00($22,000) bought a car worth rs 10,000,00($22,000) sent a son for medical studeis and an other son still in high school...how is this possible??? x says he doesnt no abt it and doesnt want to talk abt it. his brotehrs have not repaired him all he has spent for him, and when his own son asked for fees to go to the university he said he doesnt want to fund his sons univeristy education**.. So here is the situation: My parents live in Dubai, they own a property in Canada, I am the acting property manager for that property. This is our first year (2008) doing this. First question: Do we need to resubmit an application to be exempt from paying Non resident tax on a property owned in Canada each and every year? and if so, when does that application have to be resubmitted? Second and most important: I received an NR4 form with little instructions as to what it is? if i need to fill it out? Where to send it? More background: My parents make no income off of the property so they aren't required to pay the 25% of the rental income. Me and my husband are thinking of moving to Dubai or any other upcoming middle east country to work and save tax free money. I have however heard and found lots of disadvtantages: -lots of skills from India with lower pay - makes it difficult for British person to get well paid job -living expensive -only senior senior positions get paid good salaries compared to UK -unless you have money you can't have much of a life over there -Difficult to get relocation package ..we're both in the IT field (although could transfer to property/sales side), have graduated and working 3+ years.
