Voting Question: Are we taking a legal risk if we do this? Please please advise..?
My partner and I had agreed to take a rental property - the current tenants are leaving their lease early and asked us if we were sure as if they went ahead and made plans to leave they would be in a very bad position if left on the hook for rent on this property too. We said go ahead with plans, but various things changed and we now want to back out and take a different property. We can legally do this as no contract has been signed by us. We don't feel we can drop them in it so were considering making a payment to cover some of the rent while they try to relet this property ( they have already confirmed arrangements to move into another property which they own). However, if we pay something and the property still has not let after a while, will they be able to come back to us for more? Could they claim that by paying something we admitted that a verbal contract had been made and made ourselves legally liable? Please advise or give any opinion as we are having a meltdown over this, feeling that every option is a disaster! The agent has told us to walk away but we don't feel we can, so if no arrangement is reached we will end up having to take the property in next Rebecca, I know what you are saying and I did want honest opinions. The only thing I feel is that we cannot cover all the rent without actually moving in, and also that in property dealings if you rely on people's word you are taking a risk. If they had covered themselves none of us would be in this position. I have been asked to act as a rent guarantor for my sister which I am happy to do (and have done so in the past). I own a property in my home country. It has tenants, and is leased until 2010. The rental income covers the mortgage payments (actually, I have to add an extra 50 pounds a month, but I am not seeking any funds to help pay mortgage). I took on lease for my daughter in Sept 05 for six month period. Due to circumstances, I carried on paying the rent for over a year, without a new agreement. Here is a part from my lease agreement.. "This rental agreement shall commence on 15-Aug-2008 and end at 11AM on 14-Aug-2009. Tenant(s) must give 30days written notice to vacate prior to end of lease or be penalized one month's rent." I have been renting a home now for the past 7 months. I also have a roommate who is NOT on my rental agreement. Hi, We rented one basement apartment for a fixed 1yr lease via a property management company. We signed the agreement for 1yr fixed term lease and signed the PRTB form but we r not registered yet. We gave them the deposit and 1 month rent. We are not moved yet. But after spending a few hours we find that its not suitable for my pregnant wife as she feels suffocation. We moved out of our rental property on 3rd May but lease was til 12th May, have been told that landlords agent has been showing people around the property which we did not know about.. Please note that I am in ENGLAND ... This afternoon (22 June), I gave my landlord verbal notice of our intention to vacate our property on the day our current lease expires. He insisted that I give him notice in writing, so I will do this tomorrow (23 June). He is going mad about this because our lease expires on 21 July so I have actually not given a full month's notice. I accept that he's technically correct, but what can we do about this? We pay our rent on a monthly basis and I wouldn't care if he chose to calculate an extra day's rent and tack this on, but I'm certainly not paying a whole extra month. I personally feel that he should just get over it and let it go - we have been perfect tenants with regard to paying our rent on time, and we are leaving the house in perfect condition so it can be let out immediately. Please don't tell me to check the lease! We don't have a copy of it. This is because when we first moved in, my housemates and I all signed the lease but had not yet given it to the landlord, planning to make a copy of it first.
